Judd Linden is a skilled trial lawyer with landmark wins for plaintiffs and defendants in high-stakes commercial cases in state and federal courts across the country. Since starting his career at an award-winning litigation department in New York, Judd has played leading roles in every stage of the litigation process — discovery, trials, appeals, and judgment enforcement. His work has contributed to recoveries that total in the hundreds of millions of dollars for plaintiffs, as well as successful defenses of high-dollar claims for his defense-side clients.
Mr. Linden combines strategic thinking, detailed execution, and a keen sense for the facts that win cases. This approach has led to success for his clients across a range of industries and practices areas, including breach of contract, insurance litigation, class actions, employment, and breach of fiduciary duty. His clients range from private equity funds and hedge funds, to businesses, to consumer plaintiffs pursuing complex claims against large corporate defendants.
Judd has been repeatedly recognized as a New York Rising Star by Super Lawyers (2023, 2024). Among other representative engagements, Mr. Linden:
Secured a $132 million judgment in Delaware Bankruptcy Court on behalf of a Litigation Trustee and group of secured lenders against funds managed by a large private equity firm, in adversary proceedings related to the bankruptcy case of car hauler Allied System Holdings. The Trustee established that defendant repeatedly breached a credit agreement with Allied by failing to make a required equity contribution and taking actions that harmed the rights of Allied’s other secured lenders.
Successfully defended a large private equity firm at trial against a WARN Act claim brought by hundreds of steelworkers under a single employer theory in the Eastern District of Louisiana. Mr. Linden’s efforts also resulted in the district court’s decision to strike the class’s jury demand — an issue of first impression in the Fifth Circuit that was affirmed by the Fifth Circuit on appeal.
Represented a luxury hotel owner in insurance litigation in state court, with an ultimate settlement for property damage and business interruption losses arising out of Hurricane Maria.
Represents tens of thousands of individual consumer plaintiffs pursuing a large corporate defendant for violations of state and federal antitrust law. The claims allege that the defendant enforces an industry-wide platform most favored nations policy, which results in consumers paying supracompetitive prices for products sold on defendant’s distribution platform.
Played a key role in the discovery related to litigations and investigations involving a pharmaceutical company’s manufacturing, marketing, and sale of opioid medications.
Successfully proved the authenticity of an operating contract that governed his client’s business relationship with a U.S.-based supplier. After falsely alleging that the contract was forged, the defendant stipulated to the authenticity of the agreement on the eve of trial, which led to immediate arbitration of the merits of the contract dispute.
